Entry Rules & Terms of Agreement
By submitting photo/s to any Apogee Photo, Inc. photo
contest (d.b.a. Apogee Photo Magazine, the Internet’s Photography
Magazine ™, hereafter referred to as Apogee), you are attesting to the
fact that you have
read, understand, fully agree and accept the Rules and Terms of
Agreement.
You further attest that you are over 18 years of age and that you are
fully capable, willing and able to understand and comply with all the
rules and terms of this agreement.
These contests are for amateur and intermediate
photographers, NOT for professional photographers who make 50% or more
of their income from photography.
Rules:
1. Make your Pay Pal payment prior to sending Apogee your
information & photo/s. You may enter up to 10 photos per
Contest/Subject. If you would like to pay
Apogee Photo, Inc. directly with your credit card, just call
1-303-948-3539 (U.S.) between 9am and 6pm, MST, Monday - Friday.
Fees per number of photos submitted to each contest subject are as follows:
1 photo $5.00
2 photos $9.00
3 photos $12.00
4 photos $14.00
5 photos $15.00
6 photos $20.00
7 photos $24.00
8 photos $27.00
9 photos $29.00
10 photos $30.00

3. Please label your photo files with:
First initial of your first name
Last name, underscore
Portion of the contest title,
underscore,
One word photo title (number according to number of photo files
submitted: 1, 2, 3, etc.)
(Such as: JBrown_Toes_Baby3)
Failure to do so may
result in your submission not being considered and disqualified.
Please, do not submit photographs/titles that contain: nudity or
offensive content. They will not be eligible and discarded.
4. Entries Must Be Submitted by Electronic Email Means
ONLY
prior to the ending date/time of a specific contest (see
Submit your photos here...):

Size your images on your computer to:
72 ppi jpg
No more than 600 pixels along the longest edge.
(Such as a horizontal photo could be: 600 pixels wide and 400 pixels high).
Save at: Low compression/High quality
Send as an attachment/s (not inline images)
If your photographs do not meet the size requirements and formatting,
it/they may not be eligible to win and could
be disqualified.
There are many different programs for resizing your photos, such as
Photoshop, ACDSee & iphoto, so if you don't know how to do it, just
do an online Search for your companies product and you'll probably
find a
tutorial.
5. If you did not provide the required information
and/or photo size requirements and formatting (#'s 1-4 of Rules),
the contest fee/s for an ineligible/disqualified entrant
will not be returned.
6. Entries will be judged by the Apogee Photo, Inc. staff and are judged for content, composition, image quality, and
relevance to the contest topic. All decisions by the judges will be
final.
7. You may only win the Grand Prize, 1st Runner-up and 2nd Runner-up
prizes once in a one year period. There are no substitutions or transfer of
prizes.
8. Prizes must be claimed within 30 days of our notifying the winner. All attempts will be made to contact the winner via email. Failure to
claim prizes within this time period will result in forfeiture of
prizes. All entrants should check our contest page regularly to
determine the winners of each contest. Winners who have not received an
email notification should email the magazine immediately (see email
address below).
9. Cash Prizes: 50% of the submission fees received
from entrants for each specific contest subject will be allocated towards the cash prizes, called
"The Cash Prize Award".
The Grand Prize winner will receive
70% of "The Cash Prize Award".
The 1st Runner-up winner will receive
30% of "The Cash Prize Award".
Non-cash prizes will be awarded to the 2nd Runner-up.
The higher the number of participants/entrants entering a
contest--the higher "The Cash Prize Award".
The odds of winning a prize depends on the number of
eligible photographs entered. These
contests are for amateur and intermediate photographers, NOT for
professional photographers who make 50% or more of their income from
photography.
10.
Once a month or at Apogee's discretion, the number of participants and
"the cash prize award" standings will be posted on the contest page at
http://www.apogeephoto.com/contest.shtml.
11. All cash prizes will be paid to the winner/s via
Pay Pal transfer of funds. A small Pay Pal fee to the participants
may exist for the transmission of funds and winners are responsible for
any additional taxes, fees, or surcharges.
12. Contest winners will be announced on the Cover
Page of Apogee with a link to the winners page the month following the
end of a contest date.
13. Contributors to the magazine, advertisers, professional
photographers (50% or more of income derived from photography), or members of the Apogee
staff and their families are not eligible for prizes.
Terms of Agreement:
1. Apogee Photo, Inc. reserves the right to make
changes to any part of this agreement and reserves the right to amend, modify
or change the prizes and/or details of any contest at any time without
any prior notification to the participants. The changes will apply upon
the posting of such changes under specific contest details or in this
agreement. It is the responsibility of the participant to review the
contest details and these Terms of Agreement prior to submitting photo/s
to any Apogee Photo Contest.
2. Apogee, at its sole discretion, will display the
details of each photo contest: the prizes, the subject of competition(s),
the starting date of new competition(s) and the ending date of the
competition(s). The Apogee management team reserves the right to modify
or make any changes to these details.
3. By submitting your photo/image file/s to the Apogee
Photo Contest, you are giving your permission to Apogee to reproduce
them and are granting Apogee the rights to publish them in the Apogee Photo Magazine web site, or any other web site deemed
necessary for photo contest use by Apogee Photo, Inc., without monetary
compensation. This agreement constitutes a copyright release of photos
and the photographer/entrant to any Apogee contest will hold Apogee
Photo, Inc. harmless for any claims contrary to this and will indemnify
Apogee Photo for any claims by any other party.
4. Apogee Photo, Inc., warrants that all photo/image
file/s copyrights remain the property of the photographer. Apogee
Photo, Inc., shall not sell, grant the use of or give permission to use
any photo/image file/s to any third person or entity without the
written consent of the author/photographer. However, the
photographer/entrant to any Apogee Contest further understands that the
photo/image file/s shall/may remain online and become a part of Apogee’s
archives or any other site deemed necessary for use in the photo
contest, unless otherwise specified in this document.
5. The photographer/entrant to any Apogee contest
warrants that his/her/their contribution is/are their own and is their original work and
that he/they has/have the full power to make this grant, and that the photo(s) contains(contain) no matter libelous or otherwise unlawful or which
invades the right of privacy or which infringes any proprietary right.
6. It is the sole responsibility of the
photographer/entrant to any Apogee contest to have obtained an
appropriate model release when deemed necessary: certifies that he/she/they
has/have a written consent and/or proper permission of any identifiable
person in order to have said photo included/used/published in an Apogee
contest and on the Apogee web site or any other site deemed necessary
for photo contest use by Apogee. You further agree that Apogee
Photo, Inc. will not be held responsible for any violations of said
release/s, to either the photographer or the model.
7. You agree that Apogee Photo, Inc. is not
responsible for any violations of any intellectual property rights in
any photo/s submitted to Apogee Photo, Inc. and you further understand
that said photo/s will be available to the public. Apogee Photo,
Inc. has no obligation to prevent the unauthorized copying,
dissemination or alteration or other use of your photo/s by others.
8. The photographer/entrant to any Apogee contest agrees to hold harmless and
indemnify Apogee against any claim, demand, suit, action, proceeding,
recovery of expense of any claim whatsoever arriving from any claims of
plagiarism, libel, slander, obscenity, unlawfulness, or invasion of
privacy or copyright infringement of the photo(s), that are finally
sustained in a court of competent jurisdiction.
9. The photographer/entrant to any Apogee contest certifies that all aspects of
his/her/their
photo/s which may be derivative have been properly cited, and that in
general he/she/they has/have not plagiarized anyone else's work.
He/They further certifies that he/they has/have proper permission to use
any cited work which is included which exceeds the Fair Use
Clause of the United States Copyright Law, such as photographs
borrowed from other articles or persons. Permission to use
previously copyrighted material shall be obtained at the photographers’
expense from the copyright proprietor.
10. The photographer/entrant to any Apogee contest
will release and hold harmless Apogee Photo, Inc. and/or any of its
Contest Sponsors, along with their officers, directors or
representatives from all losses, including costs or expenses, or damages
as a result of the photographer/entrant to the Apogee contest violating
any of the Rules or Terms of this Agreement.
11. The
photographer/entrant to any Apogee contest also recognizes acts of God
and man can cause the Internet, the World Wide Web, and/or Apogee
Photo's Internet provider or other forms of communication (such as email
transmission delays, damage, failure, loss) to suffer periods of
inoperability and inaccessibility and agrees to release and hold Apogee
Photo, Inc. blameless for such occurrences.
12. The photographer/entrant to any Apogee contest recognizes that acts
of technology or man can be the cause for typographical errors and holds
Apogee Photo, Inc. harmless. Contact Apogee Photo Contest (below)
and Apogee will make all efforts to correct such errors.
13. The
photographer/entrant to any Apogee contest will
release and hold harmless Apogee Photo, Inc. and/or any of its Contest
Sponsors, along with their officers, directors or representatives from
all losses, including costs or expenses, or damages as a result of your
accepting, possessing and/or using any prize.
14. The photographer/entrant to any Apogee contest
agrees that under any circumstance, the liability of
Apogee Photo shall be limited only to the amount of the
contest fee paid by the photographer/entrant to any specific Apogee contest
subject. You
hereby waive any other damages whether consequential or actual.
15. Apogee Photo, Inc., is a Colorado Corporation and
all agreements, upon acceptance, shall be deemed accepted and
non-cancelable in the State of Colorado, USA and governed by the laws of
the State of Colorado, USA.

Copyright Infringement Questions:
If you feel a photo has infringed on your right of privacy and
intellectual proprietary rights, contact Apogee Photo, Inc. immediately.
Provide your name, address, phone number and email address.
Provide the location of the photo in question, along with a description
of the photo.
Provide a signed statement--state that you own the copyright to the
photo in question, that you did authorize the use of your copyrighted
photo and that your copyright has been infringed upon. Please
provide proof of the ownership of the copyright and infringement.
Your signed statement is legally binding under the penalty of perjury
law.
Once your complaint has been received, Apogee Photo,
Inc. may, at its discretion, remove the photo in question.

We respectfully ask for your help and we are hoping it will at
least slow down those most irritating spammers--spammers
that make this an extra step for you. But, it is more
important to us that we do not miss receiving your email.
