Apogee Photo Magazine
Submission Guidelines and Agreement Form
Apogee Photo is interested in providing an electronic forum for high quality work from photographic writers and photographers. We will accept articles up to 2500 words on any photographic subject geared towards the beginning to advanced photographer. Articles must have at least 3-4 photographs accompanying them. We will pay 10 cents a word for previously unpublished works (up to $150) and 3 cents a word for reprints. This amount includes usage of any photographs accompanying the article.
You must hold the copyright, and you must have signed model releases for any identifiable person or persons which appear in your photographs.
Please read the following carefully.
1. We strongly suggest you initiate contact with Apogee Photo by
first emailing us a query letter with details of your proposed photographic
article or photographic project.

If Apogee Photo accepts a submission for electronic
publication, the author and/or photographer agrees to grant Apogee Photo a royalty free non-exclusive
license to electronically publish the article and/or photograph(s) in Apogee Photo Online
Magazine; to archive back issues of Apogee Photo Online Magazine
containing the article and/or photographs(s) and to publish such back issues on the World
Wide Web; and to reduce back issues of Apogee Photo Online Magazine
containing the article and/or photographs(s) onto a fixed electronic medium such
as CD-ROM for distribution to readers.
In consideration of the publication of the Article(s), Author(s) grant(s) to the Apogee Photo, Inc (d.b.a. Apogee Photo Magazine, the Internet’s Photography Magazine ™, hereafter referred to as Apogee), the rights to publish the Article(s)/Photos in their online publication. Author(s) understand(s) that the Article(s)/photos shall remain online and become a part of Apogee’s archives, unless otherwise specified in this document.
Author(s) warrant(s) that his/their contribution is/are an original work and that he/they has/have the full power to make this grant, and that the Article(s) contain(s) no matter libelous or otherwise unlawful or which invades the right of privacy or which infringes any proprietary right.
Author(s) warrant(s) that exclusive rights of use to the Article(s)/Photos have not been assigned to any other party, or that permission has been obtained for publication in Apogee from such rights holders. Author(s) will submit copy of the permission release and copy for credit lines with his manuscript.
Author(s) agree(s) to hold harmless and indemnify Apogee against any claim, demand, suit, action, proceeding, recovery of expense of any claim whatsoever arriving from any claims of plagiarism, libel, slander, obscenity, unlawfulness, or invasion of privacy or copyright infringement in the Article(s), that are finally sustained in a court of competent jurisdiction.
Author(s) certifies that all aspects of his/their Article(s)/Photos which may be derivative have been properly cited, and that in general he/they has/have not plagiarized anyone else's work. He/They further certifies that he/they has/have proper permission to use any cited work which is included in the Article(s) which exceeds the Fair Use Clause of the United States Copyright Law, such as graphs or photographs borrowed from other articles or persons. Permission to use previously copyrighted material shall be obtained at the Authors’ expense from the copyright proprietor.
Apogee Photo, Inc., warrants that all copyrights remain the property of the author/ photographer. Apogee Photo, Inc., shall not sell, grant the use of or give permission to use any photograph or portion of this article to any third person or entity without the written consent of the author/photographer.
Apogee Photo, Inc., is a Colorado Corporation and all agreements, upon acceptance, shall be deemed accepted and non-cancelable in the State of Colorado, USA and governed by the laws of the State of Colorado, USA.
Each
author/photographer must sign this document below or on a separate copy.
I have read the above terms and agree to them. I am the author and creator of the
accompanying work and hold the copyrights in the accompanying work. I have not transferred
any ownership of my copyrights to any other person or entity. I have signed model releases
for any photograph in which the subject is clearly recognizable and for which a model
release would be required and I will provide a copy of such release upon request made by
Apogee
Photo. Apogee Photo reserves the right to not publish
each and every photograph provided or any
photograph which, in its discretion, requires a model release and for which one has not
been provided.
